Downloading, copying and sharing material, such as music, movies, games, and applications, for which the 版权 holder has not given you rights is both against the law and Vincennes University's Acceptable Use Policy for computing resources. 

The Higher Education Opportunity Act (HEOA), also referred to as H.R. 4137,已签署 于2008年8月14日生效. The HEOA primarily addresses obstacles that make it difficult for qualified students to obtain a college education, but it also includes specific 声明要求

This law requires us to take the following steps to deter illegal downloading:

  • Provide 访问 to and offer alternatives to illegal downloading

  • In order to use college computing resources, all occupants of the 文森地区大学 residence halls endorse an Acceptable Use Policy that includes a section on 版权 compliance. 
  • Beginning Spring 2011 and every semester thereafter, 文森地区大学 will send an email to all students regarding illegal distribution of 版权ed materials. 
  • 文森地区大学 policies concerning the Digital Millennium Copyright Act and our response to infringement claims are published on the MIC web site.

We currently employ bandwidth-shaping technology to prioritize network traffic. We limit the amount of bandwidth available to P2P applications but we do not filter such applications since some of the traffic is legal.

The Recording Industry Association of America (RIAA) and the Motion Picture Association of  America (MPAA) actively notifies 文森地区大学 of devices on the network that are offering and/or receiving 版权ed movies or music recordings for download 通过peer to

  • Third notification will result in permanent termination of data network 访问 for that 设备/所有者. 

In addition to any University-imposed action, any student using his/her network 访问 privileges to engage in the downloading, uploading, or other unauthorized distribution of 版权ed materials is potentially at risk of becoming the target of legal action 侵犯版权.

Summary of Civil and Criminal Penalties for Violation of Federal Copyright Laws 

Copyright infringement is the act of exercising, without permission or legal authority, one or more of the exclusive rights granted to the 版权 owner under section 106 of the Copyright Act (Title 17 of the United States Code). 这些权利包括 right to reproduce or distribute a 版权ed work. 在文件共享环境中, downloading or uploading substantial parts of a 版权ed work without authority 构成侵权.

For "willful" infringement, a court may award up to $150,000 per 工作侵犯. A court can, in its discretion, also assess costs and attorneys' fees. Willful 版权 infringement can also result in criminal penalties, including imprisonment of up to five years and fines of up to $250,000 per offense.
